For example, if you are utilizing the Services as part of your fitness facility membership (e.g., as a “Client” as defined in the Terms of Use) or as a “Trainer”(as defined in the Terms of Use) of a fitness facility, your personal information may also be provided to your fitness facility and/or your trainer. It's important to note that this Privacy Policy does not cover the collection and use of personal information by third parties, and we are not responsible for their actions. If you are a Trainer or Client, this Privacy Policy does not apply to personal information collected by a trainer or Cocast User, such as fitness assessment results or payment information. We encourage you to review the privacy practices of your fitness facility and/or Trainer before providing any personal information.
At Cocast, we are committed to protecting the personal information associated with identifiable individuals, households, and legal entities that is disclosed or provided to us through the Services. This Privacy Policy outlines our practices regarding the collection, use, and disclosure of such personal information. It also explains how we communicate with you and how you can make requests or submit inquiries about your information. Our ultimate goal is to ensure that you have a clear understanding of our privacy practices, as we value and prioritize maintaining your trust.

( 1 ) Information You Voluntarily Provide Us
a) Account Registration: In the event that you decide to register as a “User”(as defined in the Terms of Use) of our Services, you will be required to create a unique username and secure password (collectively referred to as the "Access ID"). These credentials will be utilized to establish and activate an account (the "Account") through which we can provide you with access to the Service. It is important to acknowledge and agree that certain information, including your company name, address, phone number, email address, credit card details, profile images or photos you choose to upload, and other pertinent business information, as well as the names, aliases, and email addresses of authorized individuals associated with your Account, may be necessary for us to deliver the Service to you or may be disclosed by you through the Service.
b) Fitness Information: You have the option to provide additional information to enhance your experience or enable specific features of the Services. If you are a Trainer, this information may encompass fitness plans created for Clients. If you are a Client, it may involve your fitness and body data.
c) Customer Service: Correspondence records, including email addresses and any uploaded images or photos, may be retained if you contact us via email or through our online chat feature.
d) Financial and Commercial Information: To facilitate payment processing for the Services and enhance your overall experience, we may collect billing and financial details, as well as information related to the Services provided to you. This includes details about purchases, the nature of services rendered, transaction dates and locations, payment amounts, and similar data. It's important to note that certain financial information, like your credit card number or other financial account data, may be required for efficient service delivery. All credit card information is securely managed by Cocast's payment gateway provider, following industry-standard security measures. Additionally, we may collect other Personal Information as requested by the business you're transacting with.
e) User Content: You have the option to provide additional information, in any format such as text, images, audio, and/or videos, to enhance your experience or contribute to the experiences of Trainees or Trainers. Additionally, you may choose to share feedback, participate in polls or surveys, or contact us for technical support through the Services.
f) Information Collected Via Authorized Access: if you provide your permission, we may collect and store any Personal Information you provide while using our Service (e.g. by authorizing us to access to your device's calendar application, camera, and microphone). If you have previously provided authorization and no longer wish to allow access, you may edit the application settings at the device level.
( 2 ) Information We Collect Automatically
a) Information About Your Use of the Service: We collect log data and usage information related to your use of our Services. This includes information such as your web request, Internet Protocol ("IP") address, browser type, domain names, referring and exit pages and URLs, pages viewed, and the order of these page views. We also collect information about the devices used to access the Services, such as device type and IP address. This data helps us analyze trends, administer the Services, track user engagement, and improve the overall user experience.
b) Location Information: With your consent, we may collect Personal Information regarding your location, obtained from your IP address and other sources. This information is used to match our products and services to areas of demand and for other legitimate business purposes. a) Social Media and App Information: If you choose to link your Account to third-party services or social media applications, we may collect information about you from these services. The specific types of information collected will depend on the nature of the third-party service or social media application you choose to connect to your Account. For example, if you link your Account to Google, we may import your Google profile information to enhance your experience with our Services.
b) YouTube API Data: Our Services utilize certain YouTube API Services, and by using our Services, you agree to be bound by the YouTube Privacy Policy, which can be found at https://www.google.com/policies/privacy. As part of providing our Services to you, we collect, store, process, use, and share data, content (including audiovisual content), and information provided through the YouTube API services. This includes YouTube Video ID information, connection tokens for YouTube channels, and YouTube video thumbnail information (collectively referred to as "YouTube API Data"). The collection and use of this data are essential for the functionality of our Services, such as enabling Trainers to search, select, and share video content (including training exercises) with Clients, as well as allowing Users to play YouTube content through our Services.
We want to inform you that the Vendor and the Services are not subject to the regulations of the Health Insurance Portability and Accountability Act ("HIPAA") in the United States. Therefore, when using our Services, your Personal Information will not be protected under the provisions of HIPAA. It is important to understand that our Platform operates independently from HIPAA regulations, and we recommend that you review our Privacy Policy to understand how we handle and protect your Personal Information. If you have any questions or concerns regarding the privacy and security of your information, please don't hesitate to contact us.
4. How We Use Your Personal Information

When you sign up for a subscription or make a purchase on our platform, please note that any credit card information you provide is collected and processed directly by our payment processor, which is currently Stripe, Inc. ("Stripe"), through their secure checkout service. We want to assure you that we never receive or store your full credit card information.
Stripe is a trusted and reliable payment processor that is committed to complying with the Payment Card Industry Data Security Standard (PCI-DSS) and employing industry-standard security measures to protect your payment information. Therefore, when you provide your payment details, they are encrypted and transmitted securely to Stripe for processing.

Trainer and Client: If you are a Client, information you provide may be provided to your Trainer; If you are a Trainer, information you provide to your team members.

Trainers are responsible for protecting Client’ personal information that they collect and processing that information in accordance with applicable data protection laws. Clients who have questions about Trainers’ privacy practices should contact the Trainers directly.
7. Access, Correction, and Deletion of Your Personal Information
You have the right to access, correct, update, suppress, or delete Personal Information that you have previously provided to us through our Services. To exercise these rights, you may contact us by logging into your account and making the appropriate changes or by emailing us at [email protected].
When making a request, please clearly indicate the Personal Information you would like to have changed or removed from our database. For your protection and security, we will only process requests related to the Personal Information associated with the specific email address used to send us the request. The following is a list of categories of personal information which we may collect or may have been collected from California residents within the last twelve (12) months.
Please note that the categories and examples provided in the list below are those defined in the CCPA. This does not mean that all examples of that category of personal information were in fact collected by us, but reflects our good faith belief to the best of our knowledge that some of that information from the applicable category may be and may have been collected. For example, certain categories of personal information would only be collected if you provided such personal information directly to us.

Sources of Personal Information
- Directly from you. For example, from the forms you complete or products and services you purchase.
- Indirectly from You. For example, from observing your activity on our Service.
- Automatically from You. For example, through cookies we or our service providers set on your device as you navigate through our Service.
- From service providers. For example, third-party vendors to monitor and analyze the use of our Service, third-party vendors for payment processing, or other third-party vendors that we use to provide the Service to You.
Your Rights Under the CCPA

b) Sale of Personal Information:
Cocast does not sell your personal information as part of our ordinary business practices, and we will never sell your personal information to third parties without your explicit consent.
c) Deletion Request Rights:
You have the right to request the deletion of your personal information that we have collected and retained, subject to certain exceptions.
d) Non-Discrimination:
We respect your right to not receive discriminatory treatment for exercising your CCPA rights.
e) Exercising Access, Data Portability, and Deletion Rights:

f) Use of an Authorized Agent:
If you choose to use an authorized agent to submit a request on your behalf, we will require written proof of their authorization or a copy of the power-of-attorney document.

We will not share your personal data with third parties for their direct marketing purposes to the extent prohibited by California law. If our practices change, we will comply with applicable laws and provide advance notice to you.
Our site does not currently process or respond to "Do Not Track" signals as there are no uniform standards for such signals.
